Soltysinski Kawecki & Szlezak’s litigation team is instructed in disputes relating to the construction, financial, retail and manufacturing sectors. The group is most noted for matters including infrastructural and construction disputes, shareholder disputes, and bankruptcy and restructuring proceedings, in addition to IP and industrial property protection and unfair competition. International arbitration is another strength, and lawyers have experience in arbitrations in Poland and abroad, particularly concerning investment treaties. Since January 2019, when he took over from Dariusz Skuza, Rafał Waszkiewicz is the practice head, and focuses on construction disputes. Founding partner Stanisław Sołtysiński regularly appears in arbitrations, as does Andrzej Szlęzak.

Intellectual property (Tier 1)
Soltysinski Kawecki & Szlezak’s team has niche experience in the enforcement of IP rights for major brands including Nike, Rolex and Tommy Hilfiger; the group also advises major IT industry companies on cloud computing and personal data issues. IP litigation is another area of expertise including disputes concerning employee rights to inventions and copyrights in the financial and medical equipment industries. The practice is regularly instructed by luxury brands on counterfeit mandates, as well as managing trade mark portfolios for multinationals operating in Poland. The team is co-led by Szymon Gogulski, a specialist in industrial property, unfair competition, advertising law and copyright protection; and patent, trade mark and design protection law expert Ewa Skrzydło-Tefelska. Banking and finance (Tier 2)
Soltysinski Kawecki & Szlezak houses a strong dedicated financial regulatory team, which principally advises banks and investment firms on matters including licensing and compliance. The group has developed a niche in a number of areas, including Payment Services Directive (PSD2) implementation, financial services-related advice on Brexit preparations, and fintech – drawing on the firm’s strengths in TMT. In addition to advisory work, the group also handles financing transactions for a range of financial institutions, particularly in the real estate sector. Department head Marcin Olechowski plays a leading role in a number of the team’s regulatory mandates, and is ably supported by transactional lawyer Tomasz Kanski.

Commercial, corporate and M&A (Tier 2)
Robert Gawałkiewicz leads the group at Soltysinski Kawecki & Szlezak, which often advises international corporates on their entry into the Polish market, as well as cross-border M&A. A major deal in 2018, Krzysztof Pawlisz led a group advising Solaris Bus & Coach on its acquisition by Construcciones y Auxiliar de Ferrocarriles; a matter in which the firm assisted with the auction process, due diligence, negotiations, tax and regulatory work.

Soltysinski Kawecki & Szlezak’s team is noted for its expertise in Polish and EU competition law, advising clients on merger control issues (with a particular focus on the food and fast-moving consumer goods sectors) and on antitrust issues, regularly representing clients in proceedings before the Polish Competition Authority. The department is led by Krzysztof Kanton, who has vast experience of antitrust proceedings, as well as competition litigation before the civil courts. Senior counsels Jarosław Łukawski, an expert in merger control proceedings and antitrust, and Marta Kupczak-Strzelecka, an antitrust and consumer protection expert, are also recommended.

Energy and natural resources (Tier 2)
At Soltysinski Kawecki & Szlezak, the energy and natural resources team specialises in regulatory issues and energy infrastructure developments. It also advises clients on the exploration and production of natural resources and the production, transmission, distribution, storage and trade of electricity, gas and heat. The department is co-led by Krzysztof Cichocki, who has expertise in greenfield industrial projects, and Zbyszko Wizner, whose client base includes a number of German-speaking investors.

Healthcare and life sciences (Tier 2)
Key areas for Soltysinski Kawecki & Szlezak are advising Polish and foreign producers and distributors of medical products on regulatory issues, IP enforcement and their investments. The team also has particular expertise in food law, assisting clients with bringing products to the Polish market, and handling matters such as labelling, the use of health claims and market communication. It also acts for pharmaceutical wholesalers on inspections and post-inspection proceedings, regulatory advice, as well as on the spectrum of corporate and commercial transactions. The core areas for Soltysinski Kawecki & Szlezak’s team are tax advice and planning, family and inheritance law, and business succession matters, where it acts for a range of Polish and foreign individuals with business interests in Poland. The department is led by international tax specialist Sławomir Łuczak.

Tax (Tier 2)
Soltysinski Kawecki & Szlezak’s standalone tax, customs and foreign exchange department is experienced in all areas of tax. It has particular expertise in representing clients before the tax authorities and courts, tax planning and implementation matters, tax audits and transfer pricing work, as well as contentious and non-contentious VAT issues and wealth tax management mandates. Transactional tax specialist Jarosław Bieroński leads the team, which includes ‘recognised expert’ in international tax law Sławomir Łuczak.

TMT (Tier 2)
Soltysinski Kawecki & Szlezak has developed a niche in representing software companies in court proceedings relating to the violation of software rights and digital crimes. On the non-contentious front, the team advises IT industry clients, including Microsoft, on licensing issues, cloud computing and personal data matters. It also has expertise in IT outsourcing transactions, e-commerce and the full gamut of data protection matters. The department is jointly led by IP and IT expert Mikołaj Sowiński and personal data and privacy law specialist Agata Szeliga.

White-collar crime (Tier 2)
Soltysinski Kawecki & Szlezak’s team is geared towards corporate representations and handles defence work and investigations across a wide variety of sectors; with experience in cases involving allegations of fraud, corruption, money laundering, tax evasion, creative accounting and cybercrime. It also regularly advises on business crime mitigation and criminal liability prevention as well as the establishment of regulatory compliance programmes. Tomasz Konopka heads the department, with significant experience representing clients before the Polish authorities, particularly in tax fraud cases. Katarzyna Randzio-Sajkowska is often instructed in fraud and bribery cases.

Real estate (Tier 3)
Headed up by Radosław Waszkiewicz, the team at Soltysinski Kawecki & Szlezak handles the full spectrum of real estate transactions and disputes for a variety of domestic and international funds, developers, retailers and industrial companies.
