New regulations regarding restrictions on the sale of energy drinks are now in force!

On January 1, 2024, an amendment to the Public Health Act entered into force, revolutionizing the energy drinks market in Poland.

The Act introduces a number of restrictions on the sale of energy drinks, understood as “a product in the form of a drink that is a foodstuff, included in the Polish Classification of Products and Services in class 10.89 and in Chapter 11, which contains caffeine in a proportion exceeding 150 mg/l or taurine, excluding naturally occurring substances”.

The main novelty is the ban on selling such products:

  1. to persons under the age of 18;
  2. on the premises of the units of the education system and
  3. in vending machines and the obligation to mark such products with the information “Napój energetyzujący” or „Napój energetyczny” (ENG: “Energy drink”).

Together with the above rules, the Act introduces penal sanctions for their violation.
