LITIGATION AND ARBITRATION

SK&S has had a litigation practice almost from the moment the firm was incorporated. At present, our Litigation and Arbitration practice group is the largest and one of the best in Poland. We have earned the trust of our clients and reached top positions in the Chambers Global, Legal 500 and “Rzeczpospolita” daily rankings.

We are experts in winning hard and precedent cases. We advise clients in crisis situations and in those where a dispute has already emerged, promoting amicable solutions. Where a dispute is inevitable, we represent clients before common and administrative courts, Polish and international arbitral tribunals and before European courts. We are engaged in several hundred court and arbitration cases each year, and their total value ranges from 1.5 to several billion zloty.

Our objective is always to secure a win for our clients within a reasonable timeframe. It gives us great satisfaction when a case leads to a precedent judgment that provides some order to practices in the marketplace, as was the case with Supreme Court judgments on the FIDIC contracts, on industrial designs and Community trademarks. Sometimes a winning case happens when the conflict ends before briefs are filed; this is the case when the litigation strategy we have elaborated together with the client discourages the opponent from escalating the dispute.

We care about the quality and promptness of our communication with clients. We want to understand the essence of the problem and our clients’ business expectations. Our lawyers  not only specialize in the law of procedure. We have expanded our expertise in civil and commercial law, and also seek to understand the technical and practical aspects of what our clients do. We suggest solutions and we openly discuss the risks we identify.

What unites the members of the SK&S litigation team is a passion for the law, involvement and mutual trust. Many of us, including all of the current partners, began our professional careers at the firm.

Providing professional legal assistance to clients in relation to disputes also means that we offer the assistance of other specialists, lawyers and academics, who are busy in the firm’s other practices.

We are privileged to work for the leaders in almost all business sectors. Our clients appreciate our understanding of the Polish reality and the reputation on the Polish market that we have earned. We have handled and continue to handle numerous disputes concerned with:

  • infrastructure projects, including construction of motorways, airports, power stations and manufacturing plants,
  • IT,
  • intellectual property,
  • real estates, including reprivatisation matters and damages arising out of zoning plans,
  • air law, including compensation for accidents,
  • civil liability of members of corporate bodies,
  • personal data,
  • corporate disputes,
  • competition disputes,
  • disputes with a foreign dimension, including those concerned with enforcement in Poland of foreign judgments,
  • post-arbitration disputes,
  • labour disputes,
  • post-cartel disputes.

    Dear Sirs,

We would like to inform you that in recent days, fraudulent emails impersonating our law firm have appeared online. In some cases, these emails include alleged invoices issued by SK&S.

Such fraudulent emails can be identified as they are sent from unusual, unknown addresses that do not belong to our domain. Additionally, these messages are often sent from addresses deceptively similar to those of legitimate senders. We want to emphasize that our law firm has no connection to these emails. All official correspondence from us is sent exclusively from addresses within the domain @skslegal.pl.

We have reported this matter to the Police, specifically to the Central Bureau for Combating Cybercrime, due to suspicions of criminal activity. Please exercise caution: carefully verify the sender’s address and avoid opening any suspicious emails or attachments. If in doubt, we recommend deleting such correspondence immediately.
